Please read these Terms and Conditions carefully before using the Guest Survey Platform operated by Midas Management Systems. By accessing or using this platform — whether as a hotel operator, a hotel manager, or a guest responding to a survey — you agree to be bound by these terms.
The Guest Survey Platform ("Platform") is a multi-tenant software service developed and operated by Midas Management Systems ("Midas", "we", "us", or "our"), a South African company. The Platform enables hotel groups ("Clients") to collect structured guest feedback through personalised survey links.
The Platform may only be used for its intended purpose — the collection of genuine guest feedback in connection with a verifiable hotel stay. Clients agree not to:
Participation in any survey is entirely voluntary. Guests are under no obligation to complete a survey and may close the survey link at any time. Partial responses are not saved — only fully submitted surveys are recorded.
Survey links are single-use and tied to a specific reservation. Each link expires once a response has been submitted. Guests who have already completed a survey will be shown a confirmation message if they attempt to reopen the link.
Guests are requested to provide honest and accurate feedback. Midas and its Clients reserve the right to disregard feedback that is demonstrably fraudulent, abusive, or submitted in bad faith.
All software, design, code, and documentation comprising the Platform is the intellectual property of Midas Management Systems. Nothing in these Terms grants Clients or Guests any ownership interest in the Platform or its underlying systems.
Guest feedback data collected through the Platform remains the property of the respective Client for whose property the survey was conducted. Midas does not claim ownership of individual guest responses.
Midas processes personal information as the responsible party under POPIA in connection with the operation of the Platform. The manner in which personal information is collected, stored, used, and protected is described in our Privacy Notice (POPIA).
Clients are responsible for ensuring that guests are appropriately informed that their contact details may be used to send survey invitations in connection with their stay, and that participation is voluntary.
To the fullest extent permitted by South African law, Midas Management Systems shall not be liable for:
Midas's total liability to any Client in connection with the Platform shall not exceed the fees paid by that Client in the twelve months preceding the claim.
Midas makes reasonable efforts to ensure the Platform is available at all times, but does not guarantee uninterrupted availability. Scheduled maintenance will be communicated to Clients where practicable. Midas reserves the right to suspend or discontinue the Platform or any feature of it with reasonable notice.
Midas may update these Terms and Conditions from time to time. The date of the most recent revision is shown at the top of this page. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Clients will be notified of material changes via email.
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
